Terms of Service
These terms describe the basic rules for using vpsonClick services, websites, checkout, and the customer portal.
1. Agreement to these terms
By creating an account, placing an order, accessing the customer portal, or using a vpsonClick service, you agree to these Terms of Service and any service-specific terms shown during checkout. If you do not agree, do not create an account or use the services.
2. Services
vpsonClick provides VPS hosting and related account, billing, provisioning, and service-management features. Available plans, resources, billing cycles, locations, operating-system options, and management features are shown in the relevant product or checkout flow and may vary by plan.
Service availability and functionality may depend on infrastructure providers, network conditions, maintenance, security controls, and other factors outside the direct control of the customer portal.
3. Accounts and security
You must provide accurate, current information and keep your account details up to date. Keep passwords, access tokens, and other credentials confidential. You are responsible for activity performed through your account and must promptly report suspected unauthorized access or misuse through the available support channel.
4. Acceptable use
You may use the services only for lawful purposes and in a way that does not harm the platform, other customers, or third parties. You must not:
- use the services for unlawful, fraudulent, abusive, or deceptive activity;
- host or distribute malware, phishing content, botnets, exploit kits, or other malicious code;
- perform unauthorized scanning, probing, brute-force attacks, credential attacks, denial-of-service attacks, or attempts to access systems or data without permission;
- send spam or unsolicited bulk communications, or infringe intellectual-property, privacy, or other third-party rights;
- misrepresent your identity, forge routing information, or use fraudulent payment details; or
- deliberately consume resources in a way that disrupts the platform or other customers.
5. Orders, billing, and payment
Services are billed according to the billing cycle and price displayed at checkout. Applicable taxes, including VAT where relevant, are calculated using the information available during checkout. You are responsible for providing accurate billing and tax details and for paying invoices by their due dates.
Recurring services may renew according to the selected billing cycle. Failed, reversed, or overdue payments may result in service restrictions, suspension, or termination after any applicable process described in the customer portal or service offer.
Refunds, credits, cancellations, and money-back guarantees are governed by the applicable offer, order details, and mandatory consumer rights. Confirm the current refund and cancellation rules before publication of these terms.
6. Customer responsibility for content and backups
You are responsible for the files, applications, configurations, accounts, and data that you store, process, or transmit through your services. You must maintain independent backups appropriate for your workload unless a written service description expressly says otherwise.
You are also responsible for securing and updating software installed on your VPS, including operating systems, applications, credentials, and firewall rules.
7. Availability and maintenance
We may perform maintenance, upgrades, security actions, or operational changes that affect service availability. Services may also be affected by hardware faults, network or upstream-provider incidents, attacks, force majeure events, or other causes. Any service-level commitment applies only where it is expressly included in the applicable service offer or agreement.
8. Suspension and termination
Access may be restricted or a service may be suspended or terminated where necessary to address non-payment, a breach of these terms, abuse reports, legal requirements, security risks, resource abuse, or a risk to the platform, customers, or third parties. Where practical, we will provide notice and an opportunity to resolve the issue; urgent or serious situations may require immediate action.
You may request cancellation through the customer portal or the designated support channel. Cancellation does not remove charges already incurred or obligations that survive termination.
9. IP addresses and platform resources
IP addresses and other network resources assigned to a service are provided for use with that service and remain subject to platform and upstream-provider requirements. They may be changed, withdrawn, or reassigned when required for technical, operational, legal, or security reasons.
10. Data protection
Account, billing, support, security, and service information is handled as needed to provide and protect the services, process payments, prevent abuse, comply with law, and administer the customer relationship. Details about personal-data processing, cookies, retention, and data-subject rights should be provided in the applicable privacy notice before publication.
Do not store personal data or other regulated information on a VPS unless your configuration and legal obligations support doing so.
11. Disclaimers and liability
To the maximum extent permitted by applicable law, services are provided subject to the limitations and exclusions stated in the applicable service offer. Nothing in these terms limits liability or consumer rights that cannot lawfully be limited or excluded.
Any final warranty disclaimer, liability cap, indemnity, dispute-resolution clause, governing law, and jurisdiction must be reviewed and approved for the operator’s applicable jurisdiction before these terms are published as binding terms.
12. Changes to these terms
We may update these terms to reflect changes to the services, billing flows, security requirements, or applicable law. Material changes should identify their effective date and be communicated through an appropriate customer channel. Continued use after the effective date may constitute acceptance where permitted by law.
13. Contact
For questions about these terms, billing, or service use, contact vpsonClick through the support contact published in the customer portal or on the current company profile. Confirm and publish the official legal contact details before launch.
